This privacy policy (“Privacy Policy”) is a legal agreement between you and Cycligent, Inc., a Delaware corporation, and its affiliates (“Cycligent”) for the use of the website accessed through the domain cvrworldcup.com, the applications, content, services, and services provided there and all related subdomains, including without limitation, league.cvrworldcup.com (collectively the “Website”), including the purchase of products or services offered or advertised through the Website.

By accessing the Website, you are a “User” (plural, “Users”) and are agreeing that you have freely, carefully, and completely read, fully understand, and are accepting all of the terms of this Privacy Policy, in addition to the Cycligent Terms and Conditions of Use (http://cvrworldcup.com/terms/).  If you do not agree or accept this Privacy Policy, you must immediately leave the Website without further accessing it.

Summary.  This Privacy Policy describes the information Cycligent collects, how it is used, and how it is secured.

Cycligent collects personal data about Users in relation to the use of the Website.  Cycligent collects the following data:

  • User information entered during signup or account setup, for example name, address and other contact information.
  • Data related to the Website services and User’s use thereof.
  • Data regarding virtual races.
  • Technical information from the devices of the Users.

Cycligent uses User data for the following purposes:

  • To provide services to Users and operate the CVR World Cup League and CVR World Cup races.
  • To improve existing products and services and develop new products and services.
  • To inform Users by email on Cycligent products and services that might be of interest (Users can always opt-out from this).

Cycligent will take reasonable measures to secure User data, and Cycligent stores User data on its systems for as long as Users remain a customer or for legal reasons.  Users can access their data by contacting Cycligent using the information below.

Cycligent does not share User data with anyone outside Cycligent without the express consent of the User, unless required to do so by law or as provided in the full text version of the Privacy Policy.

Introduction.  This Privacy Policy describes what kind of personal data Cycligent collects and stores in connection with the Website and how this personal data is used.  User acknowledges that this Privacy Policy is part of Cycligent’s Terms and Conditions of Use (“Terms”) and by accessing or using the Website, User agrees to be bound by both this Privacy Policy and the Terms.  If a User does not agree to abide by both this Privacy Policy and the Terms, please do not use the Website.

Information Collection and Usage.  Cycligent requires Users who request information, and subsequently register to use Website products and services, to provide contact information such as their name, address, email address, and billing information such as billing name and credit card information.

Cycligent uses the collected information to set up accounts for Users.  Cycligent may also use the information to contact Users regarding their interest in Cycligent products and services and to send information on Cycligent, Cycligent’s partners, and notices of promotions and upcoming events, if the User has opted to receive such communications.  Users may automatically be subscribed to Cycligent’s email newsletter as part of the new account setup process.  All Users have the opportunity to choose to opt-out from receiving Cycligent’s newsletter.  User information will not be shared or distributed with third parties for marketing or advertising purposes.

Except as expressly stated at the time Cycligent requests information, Cycligent does not disclose to any third-party the information provided.  All financial and billing information Cycligent collects is used solely to invoice our customers for their usage of Website products and services.  This billing information is not used by Cycligent for marketing or promotional purposes.

Cycligent uses a third-party for credit card processing.  This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided except for the sole purpose of credit card processing.

Cycligent maintains log files tracking IP addresses to analyze trends, help diagnose problems with servers and to monitor traffic/usage in order to provide better service to Users.  IP addresses are not linked to personally identifiable information.

Web Beacons.  Cycligent may use pixel tags (also known as pixel gifs or web beacons) and other methods to gather information about the emails sent to Users.  Pixel tags are tiny graphic files that are included in HTML-encoded email messages.  When such a message is opened in an HTML-capable email program, the recipient’s computer will access Cycligent’s servers to retrieve the pixel tag file, allowing Cycligent to record and store information such as email address, date and time the recipient viewed the email message, if the recipient’s email program is capable of receiving HTML, and other logging information.  Cycligent uses this information to optimize delivery of future messages to Users.

Cookie Policy.  Cycligent uses cookies to deliver content specific to your interests and to improve the convenience and efficiency of your experience when using our products and services.  A cookie is a piece of data stored on the user’s hard drive tied to statistical information about the User.  Usage of a cookie is in no way linked to any personally identifiable information in Cycligent products and email messages.  Users can always choose not to accept cookies, but Users may not be able to use some of the Website services.

Some Cycligent business partners (e.g., advertisers or tracking utility companies) may use cookies on the Website.  Cycligent does not have access or control over these cookies.  For example, Cycligent utilizes Google Analytics, a common website analytics tool.  For more information about Google Analytics, please refer to the website, “How Google uses data when you use our partners’ sites or apps” at http://www.google.com/policies/privacy/partners/.

Online Tracking; Do Not Track.  Cycligent does not track Users across third-party websites to provide targeted advertising; therefore, Cycligent does not respond to Do Not Track (DNT) signals.  However, some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you.  If you are visiting such sites, your internet browser may allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

No Collection of Children’s Personal Information.  The Website is intended for Users at least eighteen (18) years old, but is accessible for use but those who are at least fourteen (14) years old, under conditions explained in the Terms.  Cycligent does not knowingly collect any personally identifiable information from children under the age of fourteen (14).   Cycligent reserves the right to delete any information we believe to be in violation of this Privacy Policy.

Individual Choice and Access.  Cycligent works to keep User data accurate and up-to-date, to the extent that Users provide Cycligent with the information needed to do that.  If User data changes (such as a new email address), Users are responsible for notifying Cycligent of those changes.

Cycligent will retain User information for as long as the User’s account is active or as long as needed to provide User with the Website services.  Cycligent may also retain and use User information in order to comply with legal obligations, resolve disputes, prevent abuse, and enforce Cycligent’s agreements.

Cycligent will provide a User with access to any personal information held about them within thirty (30) days of any User request for that information.  Users may request this information from Cycligent by using the contact information provided above.  Unless prohibited by law, Cycligent will remove any personal information about a User from Cycligent’s servers at their request.  There is no charge for a User to access or update his or her personal information.

Security and Notice of Breach.  Cycligent will make reasonable efforts to ensure that User personal data is properly secured using appropriate technical and organizational measures, so that such data is protected against unauthorized or unlawful use, alteration, unauthorized access or disclosure, accidental or wrongful destruction, and loss.  However, nobody is safe from hackers. If a security breach causes an unauthorized intrusion into Cycligent’s system that materially affects a User, then Cycligent will promptly notify the User in accordance with applicable legal requirements.

Other Web Sites; Links.  The Website may contain links to other websites. Cycligent is not responsible for the privacy practices or the content of such websites.  As described above, third parties may independently collect information about Users when Users view advertising or other communications from third parties through Cycligent products or services.  If a User does not want those companies to collect information about the User, the User should contact them directly.

Social Media Platforms.  The Website may include social media features, like a Facebook login button for allowing users to comment of blog articles.  These features may collect User information such as an IP address and which page Users are visiting on the Website, and they may set a cookie to make sure the feature functions properly.  Social media features and widgets are either hosted by a third-party or hosted directly on the Website.  Cycligent may also maintain a presence on social media platforms like Facebook, Twitter, and LinkedIn.  Any information, communications, or materials Users submit to Cycligent via a social media platform is done at User’s risk, without any expectation of privacy.  Cycligent cannot control the actions of other users on these platforms or the actions of the platforms themselves.  User interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

Location of Information.  Cycligent has servers and offices located in the U.S. and in the United Kingdom; therefore, User information may be transferred to, stored, or processed in both the U.S., the United Kingdom, or both countries.  By using the Website, User understands and consents to the collection, storage, processing, and transfer of User information to Cycligent facilities in the U.S., the United Kingdom, and those third parties with whom Cycligent shares it as described in this Privacy Policy.

No Liability.  User understands that electronic communications may be accessed by unauthorized parties when communicated across the Internet, network communications facilities, or other electronic means.  User acknowledges and agrees that Cycligent is not responsible whatsoever for any electronic communication or any of User’s data that may be lost, altered, intercepted, or stored without authorization during the transmission of any data across networks not owned or operated by Cycligent.  Cycligent does not guarantee that User information will not be misused or disclosed to third parties.  Cycligent will not have any liability to the User for any such misuse or disclosure.

Consent.  By using the Website, User consents to the collection and use of User’s information as set forth in this Privacy Policy.  Cycligent reserves the right to make changes to this Privacy Policy and to Cycligent’s information gathering and dissemination practices.  If Cycligent changes this Privacy Policy, which Cycligent may do at any time without notice to the User, Cycligent will post those changes on the Website.  Cycligent suggests that Users periodically check the Website for changes to this Privacy Policy.

This Privacy Policy has an effective date of November 20, 2017.
